PRESIDENTIAL DECREE No. 1806

AMENDING SECTION 12 OF PRESIDENTIAL DECREE NO. 1636 WHICH AMENDED REPUBLIC ACT NO. 1161, OTHERWISE KNOWN AS THE SOCIAL SECURITY LAW

WHEREAS, in the preparation of P.D. 1636, a very important provision regarding the maximum coverage earning or compensation of all SSS members has been deleted;

WHEREAS, under the present decree, only the schedule of payment of monthly contributions appeared without mentioning the maximum salary from which said deductions should be charged; and

WHEREAS, the paragraph which has been inadvertently omitted will be beneficial to employees;

NOW, THEREFORE, I FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree the amendment of Section 12 of P.D. No. 1636:

Section 1. Section 12 of P. D. No. 1636 is hereby amended to read as follows:

"Sec. 12. Section 18 and Section 18-A of Republic Act No. 1161 are hereby combined and amended to read as follows:

"Sec. 18. Employee's contribution (a) Beginning as of the last day of the calendar month when an employee's compulsory coverage takes effect and every month thereafter during his employment, the employer shall deduct and withhold from such employee's monthly salary, wage, compensation of earnings, employee's contribution in an amount corresponding to his salary, wage, compensation, or earnings during the month in accordance with the following schedule effective on January 1, 1980:

"The maximum covered earning or compensation of all SSS members shall be limited to P1,000 per month as provided in the foregoing schedule unless otherwise provided for by the Social Security Commission through rules and regulations taking into consideration actuarial calculations and rate of benefits.

"(b) Every employer shall issue a receipt for all contributions deducted from the employee's compensation or shall indicate such deductions on the employee's pay envelopes."

Section 2. Effectivity. This Decree shall takes effect immediately.
