PRESIDENTIAL DECREE No. 1137

STANDARDIZING THE SALARIES OF ALL GOVERNMENT PROSECUTORS

WHEREAS, State Prosecutors of the Department of Justice and Provincial and City Fiscal who are covered by the provisions of Republic Act No. 5184 and Republic Act No. 6407 have not received salary adjustments since the implementation of Budget Circular No. 240 which took effect on July 1, 1974;

WHEREAS, when employees of the National Government covered by the Classification and Pay Plans administered by the Budget Commission received salary adjustments effective January 1, 1976 from 15% to 30% of their basic salaries under L.O.I. No. 345, the benefits did not extend to the members of the Prosecution Service;

WHEREAS, to preserve the morale and adequately compensate all Government Prosecutors and to attract and keep capable and efficient men in the Prosecution Service, it is necessary to raise and standardize their salaries commensurate with their duties, functions and responsibilities;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

Section 1. The provisions of existing laws to the contrary notwithstanding the salaries of State Prosecutors in the Department of Justice shall be as follows:

(a) The Chief State Prosecutor shall be paid according to his rank and grade as a member of the Career Executive Service Board. The subordinate positions shall be paid as follows:

(b) Three Assistant Chief State Prosecutors at P29,904 provided that if one or more is admitted to the CES, he shall be paid according to his rank and grade as determined by the CESB.

(c) Six Senior State Prosecutors, each at P28,668 per annum;

(d) Six Senior State Prosecutors, each at P28,248 per annum;

(e) Six Senior State Prosecutors, each at P27,185 per annum;

(f) Six State Prosecutors, each at P26,370 per annum;

(g) Six State Prosecutors, each at P25,554 per annum;

(h) Eleven State Prosecutors, each at P24,739 per annum;

(i) Eleven State Prosecutors, each at P23,923 per annum;

(j) Sixteen District State Prosecutors, each at P23,108 per annum;

(k) Two State Prosecutors, each at P21,476 per annum;

(l) Three State Prosecutors, each at P14,828 per annum;

(m) Two State Prosecutors, each at P16,311 per annum;

(n) One State Prosecutor who shall receive an annual salary of P16,270 per annum;

(o) One State Prosecutor who shall receive an annual salary of P16,185 per annum;

(p) Two State Prosecutors, each at P13,998 per annum;

(q) One State Prosecutor who shall receive an annual salary of P15,389 per annum;

(r) Five State Prosecutors, each at P15,466 per annum;

(s) One State Prosecutor who shall receive an annual salary of P12,678 per annum;

Section 2. The annual salaries of Provincial and City Fiscals shall be as herein below fixed:

(A) First Class Province

(a) Fifty-two Provincial Fiscals at P29,360 each

(b) Fifty-three First Assistants at P23,948 each

(c) Fifty-three Second Assistants at P22,243 each

(d) Forty-nine Third Assistants at P20,686 each

(e) Forty-five Fourth Assistants at P19,054 each

(f) Thirty-six Fifth Assistants at P17,423 each

(g) One Hundred Seventy-nine Assistants at P15,570 each

(B) Second Class Province

(a) Ten Provincial Fiscals at P27,803 each

(b) Ten First Assistants at P22,317 each

(c) Nine Second Assistants at P20,686 each

(d) Eight Third Assistants at P19,054 each

(e) Seven Fourth Assistants at P17,423 each

(f) Five Fifth Assistants at P15,792 each

(g) Three Assistants at P15,792 each

(C) Third Class Province

(a) Four Provincial Fiscals at P26,172 each

(b) Three First Assistants at P20,686 each

(c) Two Second Assistants at P19,054 each

(d) One Third Assistant at 17,423

(D) Fourth Class Province

Section 3. The number of positions by grade and classes may be increased or decreased through the normal budgeting procedures.

Section 4. There is hereby appropriated out of any funds in the National Treasury not otherwise appropriated such sums as may be necessary to pay the salary increases provided for in Sections 1 and 2 hereof, and thereafter, the funds needed to implement the provisions of this Decree shall be included in the Annual Appropriations Act, provided that the salary increases herein provided for shall be borne by the National Government, and provided, further that this Decree shall not apply to the City Fiscal of Manila and his Assistants, the City Fiscal of Quezon City and his Assistants, and to the City Fiscal of Pasay City. This is without prejudice to the grant of allowance to the abovementioned Fiscals by the government provided the such allowances shall not exceed twenty-five per cent of their basic salaries.

Section 5. This Decree shall take effect July 1, 1977.
