A. P. SEVA Y OTROS, recurrentes,
vs.
PABLO S. RIVERA, Juez de Primera Instancia de Negros Occidental, y EL HOGAR FILIPINO, recurridos.

HORRILLENO, J.:

Este es un recurso de avocacion promovido por A. P. Seva y otros, recurrentes, contra el Honorable Pablo S. Rivera, como Juez de la Sala Primera del Juzgado de Primera Instancia de Negros Occidental, y el Hogar Filipino, recurridos. Tiene por objeto anular las ordenes dictadas por el recurrido Juez el 26 de septiembre de 1940 y el 21 de octubre del mismo año. Fundanse los recurrentes en que tales ordenes fueron dictadas sin jurisdiccion por el recurrido Juez.

Los hechos pertinentes al caso son sucintamente como sigue:

La entidad recurrida, El Hogar Filipino, presento demanda en el Juzgado de Primera Instancia de Negros Occidental contra el recurrente A. P. Seva, en su concepto personal, y como administrador de los bienes relictos por su finada esposa, Leonor G. de Seva, reclamando de aquel el pago de la suma de P3,659.03 mas los intereses legales a razon de 6% al año en concepto de alquileres de los lotes 916 y 1064 del expediente catastral del municipio de Bacolod, Negros Occidental, de la propiedad de la entidad recurrida. En el curso de los procedimientos, los recurrentes Julia Mijares, Felipe Mijares, Juan D. Ponferrada, Jose A. Seva, Leonor Seva y Lagrimas Seva, solicitaron del Juzgado de Primera Instancia, presidido por el recurrido Juez Hon. Pablo S. Rivera, se les permitiera intervenir en el asunto como terceristas. Despues de discutido el incidente, dicho Juez lo resolvio dictando la orden de fecha 26 de septiembre arriba mencionada, que dice:

The intervenors, for the reasons stated in their motion, pray that they be allowed to intervene in this case. Attorneys for the plaintiff object to the motion. In their motion the invervenors allege the very same grounds alleged by the defendant Agustin Seva in his amended answer. It is alleged that the defendant Agustin Seva has already made an accounting of his administration of the estate of the late Leonor G. de Seva, civil case No. 5232 of this Court; that he has already delivered to the heirs thereof their shares of the proceeds of said estate; that the rents of administration properties corresponding to the period mentioned by the plaintiff in the complaint have all been delivered by the said administrator to the intervenors; that said accounting has been approved by this Court and that the said administration has been closed; and it is further alleged that in case the said defendant is condemned to pay the rents referred to in the complaint the former would be placed in the position of making two payments for the same obligation, one to his coheirs and another to the plaintiffs.

As already ruled in the order of this Court dated September 3, the mere fact that the administrator has already paid said rentals to his coheirs this payment does not relieve him of his responsibility to make the same payment to the plaintiff and that the acts imputed by the plaintiff to the defendant cannot in any way affect the intervenors for the reason that the plaintiff does not seek to enforce any claim against them, nor are they adversely affected by the complaint.

In view, however, of the fact that the intervenors voluntarily appear and admit that they have received payment of the rentals corresponding to the period mentioned in the complaint from the administrator, the Court believes that in the exercise of its discretion said intervenors may be allowed to intervene provided that they do not take issue with the plaintiff regarding the merits of its claim but confine themselves to stating the amount of rental received by them from the said administrator during the period of his administration referred to in the complaint and to tendering payment of the amount actually received by them from said administrator in case the defendant is sentenced, after trial thereof to pay any amount in the form of rental alleged to have been unduly collected by him during the period referred to in the complaint.

So ordered.

Contra esta orden los recurrentes se excepcionaron y presentaron luego un escrito en el que pedian se reconsiderara la misma. Oidas las partes sobre este extremo, el Juez recurrido, resolviendolo, expidio la orden de fecha 21 de octubre de 1940, en que denegaba dicho escrito.

Los recurrentes sostienen que el Juez recurrido se excedio de su jurisdiccion al condicionar, en su orden de 26 de septiembre, la intervencion, disponiendo que la misma se limitara solo a hacer constar la cantidad de dinero recibida por ellos de A. P. Seva como administrador de los bienes relictos por la finada Leonor G. de Seva; y que, como consecuencia de ello, la orden fechada el 21 de octubre del repetido año 1940, fue tambien dictada con exceso de jurisdiccion.

La cuestion, por tanto, que se plantea es esta: Tiene facultad el recurrido Juez para imponer ciertas condiciones a los terceristas, al admitir su intervencion? La admision de una terceria en un asunto es discrecional en el Tribunal que conoce del mismo (Art. 1.o, Regla 13, Nuevo Reglamento de los Tribunales.) Dicho Tribunal, en el ejercicio de sus facultades discrecionales, vera si la terceria causara o no una indebida dilacion o perjuicio a los derechos de las partes. (Art. 3.o, Regla 13, supra). Es por tanto, indiscutible que los Tribunales, en interes de la justicia y para evitar confusiones entre las cuestiones suscitadas por las partes en un asunto, y al objeto de que el mismo se tramite prontamente, sin dilacion ninguna, pueden imponer a estas, para conseguir estos fines, aquellas condiciones que no vulneren los derechos sustanciales de dichas partes.

Consta en autos que los recurrentes alegan en su pedimento de intervencion, como fundamento de ella, los mismos hechos alegados por el demandado A. P. Seva en su contestacion enmendada. Existe, por tanto, un interes comun entre ambos. La condicion, por consiguiente, impuesta por el Juez recurrido en el sentido de que los terceristas no deben hacer causa contra la demandante, no afecta a ninguna derecho sustancial de aquellos.

Por todo lo cual, creemos que el Tribunal a quo no obro con exceso de jurisdiccion, ni abuso de su discrecion, al dictar la orden objeto de este recurso; por lo que, fallamos declarando no ha lugar al mismo, con las costas a cargo de los recurrentes. Asi se ordena.
