AMENDING PROCLAMATION NO. 1187 DATED MARCH 27, 1998, GRANTING OWNERSHIP TO THE NATIONAL POLICE COMMISSION (NAPOLCOM) OF THE LAND DESCRIBED IN PROCLAMATION NO. 1453 DATED JUNE 30, 1975, BY AUTHORIZING THE BASES CONVERSION DEVELOPMENT AUTHORITY (BCDA) TO ADMINISTER AND DEVELOP FOR THE BENEFIT OF THE NAPOLCOM THE SAID LAND AND THOSE PROPERTIES CONVEYED BY BCDA
WHEREAS, Proclamation No. 1453 dated June 30, 1975, reserved a parcel of land with an area of 87,389 sq. m. located in Fort Bonifacio for the site of the National Police Commission hereinafter referred as “Property”, and provided that the same will automatically revert to military control when no longer needed for that purpose;
WHEREAS, Proclamation No. 1187 dated March 27, 1998 vested ownership of the Property upon the National Police Commission to which was issued Special Patent No. 3617 on December 14, 2004 by the Land Management Bureau and Original Certificate of Title No. SP8047 on June 10, 2005 issued by the Register of Deeds of Makati City;
WHEREAS, on September 8, 2004, the BCDA and the NAPOLCOM entered into a Memorandum of Agreement to implement a swap of properties in Fort Bonifacio, with the BCDA conveying and transferring to the NAPOLCOM a total land area of approximately Thirteen Thousand Seven Hundred Thirty One and Seventeen (13,731.17) square meters without land use restriction covered by Transfer Certificates of Titles and a total of Two Thousand Two Hundred Fifty (2,250) housing units in the Pamayanang Diego Silang Village, Fort Bonifacio, Taguig City, while the NAPOLCOM conveyed and transferred to the BCDA a total land area of approximately Thirty Thousand One Hundred Twenty (30,120) square meters located at Fort Bonifacio, Taguig City and approximately Twenty Thousand (20,000) square meters located at Camp Bago Bantay, Quezon City;
WHEREAS, Proclamation No. 1187 was amended by Proclamation No. 1144 on September 20, 2006 which transferred to the BCDA the administration and ownership as well as the disposal through lease or sale of the area conveyed by the NAPOLCOM. However, neither Proclamation No. 1187 nor Proclamation No. 1144 lift the restriction on the use of the site;
WHEREAS, in view of the swap of properties, the NAPOLCOM retained an area of Fifty Seven Thousand Two Hundred Sixty Nine (57,269) square meters of land at Fort Bonifacio, Taguig City which is still subject to use restrictions and an additional Thirteen Thousand Seven Hundred Thirty One and Seventeen (13,731.17) square meters for a total of Seventy One Thousand and Seventeen (71,000.17) square meters, described as follows:
a. A PARCEL OF LAND (Lot 6 of the subdivision plan Psd-00-068987, being a portion of Swo-007602-001100-D, Land SWAP, LRC Record No. ), situated in Barangay Fort Bonifacio, Makati City, Metro Manila, Island of Luzon.

WHEREAS, it is to the best interest of the NAPOLCOM and the BCDA that the Property be developed and integrated into the Bonifacio Global City vision of a seamless and world class development. Its integration will have a direct and significant impact on the value of the Property and viability of any project that will be undertaken by the BCDA;
WHEREAS, there is a great need for office buildings for NAPOLCOM, DILG and its attached agencies and housing units for deserving and qualified NAPOLCOM and if feasible, DILG and its attached agencies employees;
WHEREAS, to pursue the abovementioned development, there is a need to authorize the BCDA to administer and develop the Property subject to NAPOLCOM specifications in accordance with the vision and concept of Bonifacio Global City;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:
Section 1. Use Restriction.
a. The following phrase under Proclamation No. 1453 dated June 30, 1975 is hereby repealed and revoked:
“x x x and to the condition that the area shall automatically revert to military control when no longer needed for the purpose stated x x x”
b. The third paragraph of Proclamation No. 1187 dated March 27, 1998 is hereby amended to read as follows:
“The land may be used as the site for the National Police Commission or, in the latters discretion, it may be devoted to any purpose whatsoever or disposed of in any manner consistent with law. Any use restriction upon the land shall immediately be removed or lifted upon the disposition of the land or any part thereof by the Commission to third parties.”
Section 2. Disposal of the Property.
In view of the need of NAPOLCOM and DILG for office buildings and housing units for deserving and qualified NAPOLCOM employees, and DILG employees if feasible, the BCDA is hereby authorized to administer and develop the property of NAPOLCOM, subject to NAPOLCOM specifications to ensure that the desired development is realized and in accordance with the vision and concept of Bonifacio Global City.1aшphi1
Section 3. This Proclamation shall take effect immediately.
