[ Proclamation No. 495, November 23, 1989 ]

DECLARING THE EFFECTIVITY OF EXECUTIVE ORDER NO. 292, THE “ADMINISTRATIVE CODE OF 1987”, AS AMENDED

WHEREAS, Section 29, Book VII, of Executive Order No. 292, dated July 25, 1987, as amended by Republic Act No. 6682, provides that: “Effectivity. – This Code shall take effect two years after its publication in the Official Gazette;”

WHEREAS, the National Printing Office has certified that Executive Order No. 292 was published in the Supplements to the Official Gazette, dated September 21, 1987 (Volume 1) and September 28, 1987 (Volume II), and which Supplements were released on November 23, 1987 and November 24, 1987, respectively;

WHEREAS, in Opinion No. 198, dated September 28, 1988, on the question of the date of effectivity of Executive Order No. 292 (prior to its amendment), the Secretary of Justice, citing a similar case, ruled that “[t]he date of publication as basis for computing the date of effectivity of the law is the date of actual release for circulation”;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby declare November 23, 1989, as the date of effectivity of Executive Order No. 292, the “Administrative Code of 1987”, as amended.
