[ Proclamation No. 390, March 17, 1989 ]

SETTING THE DATE FOR THE HOLDING OF A PLEBISCITE TO DECIDE THE CREATION OF THE MUNICIPALITY OF LIMASAWA, PROVINCE OF SOUTHERN LEYTE

WHEREAS, Presidential Decree No. 1549, dated June 11, 1978 (published: January 22, 1979), provides for the creation of the Municipality of Limasawa, Province of Southern Leyte, out of all the barangays and sitios in the island of Limasawa, Municipality of Padre Burgos, Province of Southern Leyte;

WHEREAS, Sec. 10, Art. X, of the 1987 Constitution provides that: “No province city, municipality, or barangay may be created, divided, merged, abolished, or its boundary substantially altered, except in accordance with the criteria established in the local government code and subject to the approval by a majority of the votes cast in a plebiscite in the political units directly affected;” and

WHEREAS, the Department of Local Government has recommended the holding of a plebiscite to determine whether the barangays specified therein shall become a new municipality to be known as the Municipality of Limasawa;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby direct the following:

(1) On March 28, 1989, a plebiscite shall be held in all barangays and sitios in the island of Limasawa in the Municipality of Padre Burgos, Province of Southern Leyte, to determine whether the said barangays shall become a new municipality to be known as the Municipality of Limasawa, Province of Southern Leyte; and

(2) The Commission on Elections shall supervise the conduct of the aforesaid plebiscite and shall promulgate the rules and regulations necessary to implement this proclamation.1aшphi1
