AMENDING PROCLAMATION NO. 1835 BY EXTENDING THE PERIOD FOR THE FILING OF CERTIFICATES OF CANDIDACY FOR REGIONAL REPRESENTATIVES IN THE SANGGUNIANG PAMPOOKS IN REGIONS IX AND XII, AND FOR OTHER PURPOSES.

WHEREAS, the president has been empowered under Batas Pambansa Blg. 20 to fix the date for the filing of certificates of candidacy for Regional Representatives to the Sangguniang Pampooks in Regions IX and XII;

WHEREAS, in accordance with the provisions of Batas Pambansa Blg. 20, the President has fixed the deadline for the filing of certificates of candidacy on April 12, 1979; and

WHEREAS, there are circumstances peculiar to the regions which necessitates an extension of the deadline, as recommended by the COMELEC, for the submission of official candidates of duly registered political parties or groups and individuals;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby promulgate the following proclamation;

Section 1. Extension of Deadline. — Notwithstanding the provisions of Proclamation No. 1835, political parties or groups who have nominated candidates in accordance with the deadline fixed under Proclamation No. 1835, which is April 12, 1979, may withdraw their nominated candidates and substitute them with new candidates or complete their ticket if the authorized number has not been completed as of April 12, 1979, no later than April 30, 1979;

Section 2. Individual Certificates of Candidacy. — Notwithstanding the provisions of Proclamation No. 1835, individuals may file certificates of candidacy with the Regional Election Director concerned not later than the day before the election, citing the reasons for failure to observe the deadline as established by Proclamation No. 1835.

The COMELEC is hereby empowered to determine whether or not to give due course to such certificate of candidacy.

Section 3. Instruction to the Citizens Election Committees. — Whenever such substitution or additional inclusions are made in accordance with the rules promulgated by COMELEC, the citizens election committee of the region concerned shall be duly informed and shall be instructed to make such adjustments as to the withdrawal and to include such new nominees in the ticket of the political party or group concerned, such candidate nominated by the political party or group shall be entitled to the benefits of block voting and individual candidates shall be treated as such.1aшphi1
