ESTABLISHING AS RESERVATION FOR THE PURPOSE OF THE EXPLORATION, DEVELOPMENT, EXPLOITATION AND UTILIZATION OF GEOTHERMAL ENERGY, NATURAL GAS AND METHANE GAS A PARCEL OF LAND IN THE PROVINCE OF LEYTE, ISLAND OF LEYTE, PHILIPPINES.
WHEREAS, under Republic Act No. 5092, the Government reserves the right to undertake the exploration for, tapping, or utilization of geothermal energy, natural gas or methane gas either by itself or thru its instrumentalities, or thru competent persons qualified to undertake such work as independent contractor or contractors;
WHEREAS, the Commission on Volcanology of the National Science Development Board and the Bureau of Mines had been and are still conducting preliminary exploration work for the utilization of geothermal energy in an area in the province of Leyte; and
WHEREAS, it is to the interest of the State that the land covered by the exploration work and the surrounding areas be reserved for this purpose;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, upon recommendation of the Secretary of Agriculture and Natural Resources, and to implement the provisions of Section 5, Republic Act No. 5092, hereby set apart as reservation under the administration of the National Power Corporation for the purpose of developing, exploiting and utilizing geothermal energy, a parcel of land in the province of Leyte, Island of Leyte, Philippines, more particularly described and bounded, as follows:
Beginning at a point “1”, whose geographic position is 11º 08' 12' latitude and 124º 36' 14" longitude, located at the City of Ormoc, island of Leyte;
Thence, due northeast to point “2”, whose geographic position is 11º 10' 37" latitude and 124º 39' 52" longitude, located at the municipality of Kananga;
Thence, due southeast to point “3”, whose geographic position is 10º 51' 43" latitude and 124º 53' 28" longitude, located at the municipality of La Paz;
Thence, due southwest to point “4”, whose geographic position is 10º 49' 13" latitude and 124º 49' 50" longitude, located at the municipality of Baybay;
Thence, due northwest to point “1”, which is the point of beginning, containing an approximate area of Thirty-four Thousand Three Hundred Sixty (34,360) Hectares.
This reservation is subject to private rights, if any there be, and no entry into private property shall be made without the prior consent and approval of the owners as provided under existing laws.1aшphi1
