ESTABLISHING AND CREATING THE TONDO CONDOMINIUM PROJECT AND DECLARING THE LANDS AND BUILDINGS BELONGING TO THE NATIONAL GOVERNMENT TENEMENT HOUSES, SITUATED IN VITAS, TONDO, MANILA, FOR SALE TO THE ACTUAL OCCUPANTS OF THE APARTMENT UNITS THEREAT, IN CONSONANCE WITH THE CONDOMINIUM LAW AND PERTINENT PROVISIONS OF THE PUBLIC LAND LAW.

Pursuant to the powers vested in me, I, FERDINAND E. MARCOS, President of the Philippines, do hereby establish and create the Tondo Condominium Project in consonance with the Condominium Law (R.A. 4726) and open to disposition by sale to the said Condominium Project, under the pertinent provisions of the Public Land Law, in favor of the actual occupants of the apartment units of the buildings known as the Government Tenement Houses, the land of the public domain and buildings thereon, situated in Vitas, Tondo, Manila, which parcel of land is more particularly described as follows:

“A parcel of land, portion of the foreshore land, formed by the alluvial action of the Vitas Creek and the Manila Bay, bounded in the Northeast by Estero de Vitas; in the Southeast and South by the titled lot of Procter and Gamble PMC, and on the West by Vitas Street up to the Estero de Vitas, starting from point No. 1, which is the northernmost corner of the titled lot of PMC, along the Estero, de Vitas to point No. 2 with a distance of 12.77 meters, more or less, with the approximate bearing of North 82 29 West; hence to point No. 3, some 88.45 meters with an approximate bearing of South 30 East; hence to point No. 4, some 76.69 meters, with an approximate bearing of South 59 22West; hence to point No. 5, some 237.79 meters, with an approximate bearing of North 27 091 West; hence to point No. 6, some 23.07 meters with an approximate bearing North 67 371 East; then to point No. 7 some 160.14 meters, with an approximate bearing of South 49 121 East; containing 15,000 square meters more or less, subject to future survey by the Bureau of Lands and award of patents to the Condominium corporation and to the tenants.

The Lands shall be surveyed and subdivided by the Director of Lands who shall set aside such portions as may be needed for streets, alleys and other necessary public improvement or community purposes.

The tenants, their heirs or successors-in-interest of the apartment units, duly certified by the Department of Social Welfare, as of December 31, 1968, shall organize themselves into a non-stock, non-profit condominium association which shall own and hold title to the common areas for the Tondo Condominium Project; manage the said condominium project pursuant to the provisions of Republic Act No. 4726, assess each condominium and member; receive payments; impose fines, including liquid led damages: enforce ejectment or expulsion proceeding according to duly adopted mutually-beneficial rules and regulations which may be promulgated by the said management body.

The lands herein involved, shall be appraised and disposed of in favor of the actual occupants of the apartment units at the same value as stated in the Tondo foreshore Act, that is at Five Pesos (P5.00) per square meter. The buildings therein situated are donated to the Tondo Condominium Project, for it to preserve, service and maintain, for as long as the Association deems it necessary, a symbol of the First Housing Project by the Champion of Social Justice, the President Manuel L. The PHHC is hereby directed to execute the necessary Master Deed and the Declaration of Restrictions as required by the Condominium Law taking into consideration the humble status of the occupants therein and their desire to manage their own affairs. A panel to consist of two directors and a representative of the Tondo Condominium Association shall be organized, within thirty (30) days from date of this promulgation, to study and adopt all measures necessary for the efficient operation or execution of this proclamation.
