[ Proclamation No. 218, June 23, 1967 ]

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 731 DATED SEPTEMBER 27, 1934, A CERTAIN PARCEL OF THE PUBLIC DOMAIN SITUATED IN THE BARRIO OF SAN PEDRO, MUNICIPALITY OF PASUQUIN, PROVINCE OF ILOCOS NORTE, AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF THE MINING ACT.

WHEREAS, a petition has been filed for the exclusion of a certain parcel of land from the operation of Proclamation No. 731 dated September 27, 1934, which established the Metropolitan Watershed Forest Reserve;

WHEREAS, according to the geological investigation report of the Director of Mines, the area sought to be excluded from the Metropolitan Watershed Forest Reserve appears to be highly mineralized with good grade feldspar and more valuable for its mineral contents than for forest purposes;

WHEREAS, under the provision of Section 14 of Commonwealth Act No. 137, as amended, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservation by the President of the Philippines with the concurrence of Congress;

NOW, THEREFORE, upon recommendation of the Secretary of Agriculture and Natural Resources and pursuant to the provision of Section 14 of Commonwealth Act No. 137, as amended, otherwise known as the Mining Act, I, FERDINAND E. MARCOS, President of the Republic of the Philippines, do hereby exclude from the operation of Proclamation No. 731, dated September 27, 1934, which established the Metropolitan Watershed Forest Reserve, and declare open to disposition under the provisions of the Mining Act, a certain parcel of the public domain situated in the Barrio of San Pedro, Municipality of Pasuquin, Province of Ilocos Norte shown in the attached white print map and particularly described as follows, to wit:

Beginning from a point marked “1” on plan (Corner 9, PR-135) being S 74° 03' E, 3550.67 meters from BLBM No. 1, Sto. Domingo, Municipality of Pasuquin, Province of Ilocos Norte;

Thence N 56° 56' W, 507.67 meters to Corner 2;

Thence N 13° 38' W, 449.48 meters to Corner 3;

Thence N 66° 46' W, 458.09 meters to Corner 4;

Thence N 58° 26' W, 55.94 meters to Corner 5;

Thence D-N, 550 meters to Corner 6;

Thence D-E, 300 meters to Corner 7;

Thence D-N, 300 meters to Corner 8;

Thence D-E, 700 meters to Corner 9;

Thence D-S, 1,773.79 meters to Corner 1, the point of beginning containing an area of approximately 119.0549 hectares. All points referred to are indicated on plan and on the ground are marked as follows: Corners 1, 2, 3, and 4 are old Corners of PR-135 and all the rest are PS-concrete cylindrical monuments 15 cms. in diameter by 60 cms. long.

The cutting, removal, and utilization of the timber and other forest products therefrom shall be in accordance with the provisions of the existing Forest and Internal Revenue Law and Regulations. Provided, further, that if within three years from the date of the granting of the lease by the Government, the lessee does not start the exploitation of the mineral resources or upon the termination of the exploitation and at any time said area shall be abandoned for mining purposes, the said parcel of land shall automatically be reverted as part of the Metropolitan Watershed Forest Reserve.

This proclamation shall take effect only upon the concurrence of Congress of the Philippines.1aшphi1
