EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 245, DATED JANUARY 18, 1956, CERTAIN PARCELS OF THE PUBLIC DOMAIN EMBRACED THEREIN, SITUATED IN THE MUNICIPALITY OF SAN MARCELINO, PROVINCE OF ZAMBALES, AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF THE MINING ACT

WHEREAS, a petition has been filed for the exclusion of certain parcels of land from the operation of Proclamation No. 245, dated January 18, 1956, which established the Southern Zambales Forest Reserve;

WHEREAS, the findings of the Director of Mines, show that the areas sought to be excluded from the Southern Zambales Forest Reserve appear to be highly mineralized; and

WHEREAS, under the provisions of Section Fourteen of Commonwealth Act Numbered One Hundred and Thirty-Seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservation by the President with the concurrence of the Congress of the Philippines.

NOW, THEREFORE, upon the recommendation of the Secretary of Agriculture and Natural Resources and pursuant to the provisions of Section Fourteen of Commonwealth Act No. 137, otherwise known as the Mining Act, I, Carlos P. Garcia, President of the Philippines, do hereby exclude from the operation of Proclamation No. 245, dated January 18, 1956, certain portions of the Southern Zambales Forest Reserve situated in the municipality of San Marcelino, province of Zambales, and declare the same open to disposition under the provisions of the Mining Act, which areas are particularly described, to wit;

1. Beginning at a point marked corner 1, which is identical to corner 10, Communal Pasture Parcel 1, San Marcelino, Zambales, described in the Bureau of Forestry Map No. Cn. P-74 and in the herein attached plan, being N52W, about 550 meters to corner 2, thence to corner 3, N5W, 710 meters; thence to corner 4, N16E, 170 meters; thence to corner 5, N12W, 190 meters; thence to corner 6, N17E, 220 meters; thence to corner 7, N11E, 210 meters; thence to corner 8, N7E, 220 meters; thence to corner 9, N48E, 180 meters; thence to corner 10, N80E, 300 meters; thence to corner 11, N68W, 170 meters; thence to corner 12, N83E, 360 meters; thence to corner 13, S86E, 410 meters; thence to corner 14, N81E, 720 meters; thence to corner 15, N76E, 290 meters; thence to corner 16, S54E, 550 meters; thence to corner 17, S39W, 790 meters, thence to corner 18, S30W,820 meters; thence to corner 19, S34W, 820 meters; thence to corner 20, S15W, 370 meters; thence to corner 21, S81W, 530 meters; thence to corner 22, S76W, 530 meters; thence to corner 23, N39W, 430 meters; thence to corner 1, N52W, 250 meters; and containing an area approximately 631,2800 hectares.1aшphi1

The cutting, removal, and utilization of timber and other forest products therefrom shall be in accordance with existing Forest and Internal Revenue Laws and Regulations, and at any time the said area shall not be utilized for mining purposes, the same shall revert as part of the Southern Zambales Forest Reserve.

This Proclamation shall take effect only upon the concurrence of the Congress of the Philippines.
