Proclamation No. 112

MAKING PUBLIC THE TREATY OF FRIENDSHIP BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE SPANISH STATE.

WHEREAS, a Treaty of Friendship between the Republic of the Philippines and the Spanish State designed to strengthen further the bond of friendship now happily existing between them in a manner befitting their historic and cultural ties, was concluded and signed by the respective plenipotentiaries of the two Governments at Manila, on September 27, 1947;

WHEREAS, in its Resolution No. 47, adopted on April 14, 1948, the Senate of the Philippines concurred in the making of the said Treaty of Friendship, with a reservation which is quoted as follows:

"Resolved, That the Senate of the Philippines concur, as it hereby concurs in the Treaty of Friendship between the Republic of the Philippines and the Spanish State which was concluded and signed at Manila on September twenty-seven, nineteen hundred and forty-seven, with the understanding, that nothing in the Treaty shall be construed as affecting, altering, amending or repealing any of the existing constitutional provisions, statutes or laws, of the Republic of the Philippines prohibiting aliens, or limiting or regulating their rights to acquire, possess, and dispose of movable or immovable property, to establish and maintain schools of learning, to reside and travel, and to engage in trade, industry, and other pursuits."

WHEREAS, the said Treaty has been duly ratified and confirmed by the President of the Philippines subject to the interpretation of the Treaty placed by the Philippine Government in an exchange of notes between the Republic of the Philippines and the Spanish State, dated April 7, 1948, and April 12, 1948, respectively, and to the reservation in the resolution of concurrence of the Philippine Senate, quoted above;

WHEREAS, the said Treaty has been duly ratified on behalf of the Government of the Spanish State;

WHEREAS, the instruments of ratification of the said Treaty of the two Governments were exchanged at Manila, Philippines, on the 25th day of July, 1948; and

WHEREAS, the said Treaty shall enter into force on the exchange of instruments of ratification;

NOW, THEREFORE, be it known that I, Elpidio Quirino, President of the Philippines, have caused the said Treaty, with the instruments of ratification and the exchange of notes annexed thereto, to be made public to the end that the same and every article and clause thereof may be observed and fulfilled with good faith by the Republic of the Philippines and the citizens thereof.

IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
