[ Proclamation No. 799, December 22, 1941 ]

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 208 DATED OCTOBER 5, 1937, AND OPENING TO DISPOSITION UNDER THE PROVISIONS OF ACT NO. 2719, AS AMENEDED, TWO PARCELS OF LAND SITUATED IN THE BARRIO OF CAMP 7, MUNICIPALITY OF MINGLANILLA, PROVINCE OF CEBU, ISLAND OF CEBU.

WHEREAS, petitions have been filed for the release of two parcels of coal-bearing land located in the barrio of Camp 7, municipality of Minglanilla, province of Cebu, island of Cebu, from the Talisay-Minglanilla Estate Forest Reserve established under Proclamation Numbered Two hundred and eight, dated October fifth, nineteen hundred and thirty-seven;

WHEREAS, according to the information of the Director of Lands, concurred in by the Director of Forestry and the Secretary of Agriculture and Commerce, the aforesaid parcels of lands form part of the patrimonial properties of the Government as they are portions of the Talisay-Minglanilla Friar Lands Estate over which the Government holds a Torrens title;

WHEREAS, according to the findings of the Director of Mines, concurred in by the Secretary of Agriculture and Commerce, the said parcels of lands included in the Talisay-Minglanilla Estate Forest Reserve appears to be mineralized; and

WHEREAS, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President of the Philippines only with the concurrence of the National Assembly;

NOW, THEREFORE, I, MANUEL L. QUEZON, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Proclamation Numbered Two hundred and eight, dated October fifth, under the provisions of Act No. 2710, as amended, the following two parcels of land situated in the barrio of Camp 7, municipality of Minglanilla, province of Cebu, island of Cebu, and described on plans Crps-243 and Bsm,-48 respectively, to wit:

Beginning at a point marked “1” on plan Crps-243, being N. 55 deg. 20’ W., 20.00 meters from M.B.M. No. 12, Toledo-Minglanilla, Cebu, thence N. 55 deg. 20’ W., 200.00 meters to point “2”; thence N. 34deg. 40’ E., 200.00 meters to point “3” thence S. 55 deg. 20’ E., 200 meters to point “4”; thence S. 34 deg. 40’ W., 200.00 meters to point “1”, which is the point of beginning.

Containing an area of 4.0000 hectares.

Northeast – by Talisay-Minglanilla Forest Reserve (Flr-133, Case No. 2);

Southeast – by Talisay-Minglanilla Forest Reserve (Flr-133, Case No. 2);

Southwest – by land claimed by Alejandro Rallos and public land;

Northwest – by Talisay-Minglanilla Forest Reserve (Flr-133, Case No. 2);

Bearings: True: Declination: 1 deg. 25’ E.

West – by Talisay-Minglanilla Forest Reserve.

Bearings: True Declination: 1° 25’ E

Date of Survey: July 15 to 23, 1941, by Victorino Gonzales, Mineral Land, Surveyor.

The surface thereof may be leased for not more than three (3) years and rentals paid in advance to the Bureau of Lands at not less than five per cent (5%) per annum of the value of the land in accordance with the provisions of Section 14 of Lands Administrative Order No. 3-4, which lease may be removed for like period at the discretion of the Director of Lands.

The cutting, removal, disposal of timber and other forest products shall be under the supervision and control of Bureau of Forestry and at any time the said parcels of land shall be abandoned for mining purposes, the same shall revert to as part of the Talisay-Minglanilla Estate Forest Reserve

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly or the Congress of the Philippines, as the case may be, duly adopted for the purpose.
