EXCLUDING FROM THE OPERATION OF PROCLAMATION NO 217, DATED FEBRUARY 16, 1929, AND OPENING TO DISPOSITION UNDER THE PROVISIONS OF COMMONWEALTH ACT NO. 137 FOUR PARCELS OF LAND SITUATED IN THE BARRIOS OF ACUPAN, CHALECNO AND VIRAC, MUNICIPAL DISTRICT OF ITOGON, SUB-PROVINCE OF BENGUET, MOUNTAIN PROVINCE, ISLAND OF LUZON, PHILIPPINES.

WHEREAS, a petition has been filed for the release of certain mining claims located in the Barrios of Acupan, Chaleono and Virac, Municipal District of Itogon, Mountain Province, Island of Luzon, Philippines, from the Central Cordillera Forest Reserve established under Proclamation numbered Two Hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine;

WHEREAS, according to the report of a mining engineer concurred in by the Director of Mine a and the Secretary of Agriculture and Commerce, the parcels of land embraced in the said mining claims included in the Central Cordillera Forest Reserve appear to be mineralized; and

WHEREAS, under the provisions of Section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President, of the Philippines only with the concurrence by the National Assembly;

NOW, THEREFORE, I, MANUEL L. QUEZON, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Proclamation Numbered Two Hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine, the following parcels of land situated in the Barrios of Acupan, Chalecno and Virac, Municipal District of Itogon, sub-province of Benguet, Mountain Province, Island of Luzon, and described on plans Nos. Bsm-46 and 47, to wit:

Parcel No. 1 (Bsm-4-6, Barrio Acupan)

Beginning at a point marked “1” on plan Bsm-46, Parcel No. 1, being S 20° 35' W., 1042.83 meters, more or less from B.L. Triangulation Station “Itogon” thru Lp-394, Municipal District of Itogon, sub-province of Benguet, Mountain Province, thence

S 4° 25’ W., 264.60 meters to point “2”; thence

Beginning at a point marked “1” on plan Bsm-46, Parcel No. 2, being S 19°.02' W., 1667.73 meters, more or less from B. L. Triangulatlon Station “Itogon” thru Lp-394, Municipal District of Itogon, Sub-Province of Benguet, Mountain Province, thence

Due East, 56.55 meters to point “2”; thence

Containing an area of 1.1276 hectares.

Bounded on the North, by “Todo” (Bsm-9-D, Group No. 1) mineral claim of Benguet Consolidated Mining Company; East by “Elibh Fr.” (un-surveyed) mineral claim of Pugo Mining Company; South, by “Coros” (unsurveyed) mineral claim of Pugo Mining Company; West, by “Wasi” (Bsm-9-D, Group No. 1) mineral claim of Benguet Consolidated Mining Company.

Parcel No. 1 (Bsm-47. Barrio Chalecno)

Beginning at a point marked “1” on plan Bsm-47, Parcel No. 1, being N 9° 49' W’., 640.77 meters, more or less, from B. L. triangulation station “Itogon”, thru Lp-203, Municipal District of Itogon, Sub-Province of Benguet, Mt. Province, thence

S 87° 15’ W., 67.70 meters to point “2”; thence

Containing an area of 0.1341 hectares.

Parcel No. 2 (Bsm-47, Barrio Virac)

Beginning at a point marked “1” on plan Bsm-47 Parcel No. 2, being N 4 deg. 07' W., 1886.91 meters, more or less, from B. L. Triangulation Station “ltogon”, thru Lp-382, Municipal District of Itogon, Sub-Province of Benguet, Mountain Province, thence

N 15° 04’ W., 300.00 meters to point “2”; thence
N 74° 56’ E., 221.72 “ “ “ “3”

Containing an area of 5.8246 hectares.

Bounded on the North, by “Rio” (unsurveyed) mineral claim of Gold Creek Mining Company; East by “Nevada Fr.” (unsurveyed) and “California Fr.” (Lp-295-A-D) mineral claims of Itogon Mining Company; South, by “Mateo” (Lp-382) mineral claim of Balatoc Mining Company; West, by “Campo” (Lp-381) mineral claim of Balatoc Mining Company.

The four (4) parcels of land described above, contain a total area of 13.6993 hectares.

The cutting, removal and disposal of the timber and other forest products shall be under the supervision and control of the Bureau of Forestry and that any time the said parcels of land shall be abandoned for mining purposes, the same shall revert to as part of the Central Cordillera Forest Reserve.

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly or the Congress of the Philippines, as the case may be, duly adopted for the purpose.1aшphi1
