EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 217, SERIES OF 1929, THE FOUR PARCELS OF LAND SITUATED IN THE BARRIOS OF ANTAMOK AND GUMATDANG, MUNICIPAL DISTRICT OF ITOGON, SUB-PROVINCE OF BENGUET, MOUNTAIN PROVINCE, ISLAND OF LUZON, PHILIPPINES AND DECLARING THE SAID FOUR PARCELS OF LAND OPEN FOR MINING PURPOSES.

WHEREAS, a petition has been filed for the release of certain mining claims located in the Barrios of Antamok and Gumatdang, Municipal District of Itogon, sub-Province of Benguet, Mountain Province, Island of Luzon, from the Central Cordillera Forest Reserve established under Proclamation Numbered Two-hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine;

WHEREAS, according to the findings of a licensed mining engineer, concurred in by the Director of Mines and the Secretary of Agriculture and Commerce, the land embraced in the said mining claims included in the Central Cordillera Forest Reserve appears to be mineralized; and

WHEREAS, under the provisions of Section fourteen of Commonwealth Act Numbered One Hundred and thirty-seven, otherwise known us the Mining Act, lands within reservations for purposes other than mining which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President of the Philippines only with the concurrence of the National Assembly;

NOW, THEREFORE, I, MANUEL L. QUEZON, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Proclamation Numbered Two hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine, the following four (4) parcels of land situated in the Barrios of Antamok and Gumatdang, Municipal District of Itogon, sub-province of Benguet, Mountain Province, Island of Luzon, and described on plan Bsm-45, to wit: Parcel No. 1 (Barrio Gumatdang)

Beginning at a point marked “1” on plan Bsm-45, Parcel No. 4, being S 52°.43' E., 1033.36 meters, more or less, from triangulation station “Bua” (called Baguio) = BLLM No. 1, Barrio of Antamok, Municipal District Of Itogon, Sub-Province of Benguet, Mountain Province, thence

Due East, 38.78 meters to point “2”; thence
Due South, 291.90 “ “ “ “3”; “

Due North 291.90 “ “ “ “1”, which is the point of beginning

Containing an area of 1.1320 hectares.

Bounded on the North, by “U – 11 Fr.” (unsurveyed) mineral claim of Benguet Consolidated Mining Company; East, by “Desert” (Lps-39) mineral claim of Leonard Lehlbach and “Dorothy” Lps-38) mineral claim of Thos. Colston Kinney; South, by Bsm-45, Parcel No. 3, surveyed for Atok Gold Mining Company; West, by “Susana” (L1-1443-D) mineral claim of the Big Wedge Mining Company.

The cutting, removal and disposal of the timber and other forest products shall be under the supervision and control of the Bureau of Forestry and that any time the said four (4) parcels of land shall be abandoned for mining purposes, the same shall revert to as part of the Central Cordillera Forest Reserve.

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly or the Congress, of the Philippines, as the case may be, duly adopted for the purpose.
