EXCLUDING FROM THE OPERATION OF FORESTRY ADMINISTRATIVE ORDER UNNUMBERED, DATED MAY 20, 1922, AND OPENING TO DISPOSITION UNDER THE PROVISIONS OF COMMONWEALTH ACT NO. 137, A PARCEL OF LAND SITUATED IN THE SITIO OF BUYAG, BARRIO OF MALOBAGO, MUNICIPALITY OF CATAIÑGAN, PROVINCE OF MASBATE, ISLAND OF MASBATE, PHILIPPINES

Whereas a petition has been filed for the release of a certain mining claim located in the sitio of Buyag, barrio of Malobago, municipality of Cataiñgan, province of Masbate, from Communal Forest Parcel I established for the municipality of Cataiñgan, under Forestry Administrative Order Unnumbered, dated May 20, 1922;

Whereas, according to the findings of the Director of Mines and the Director of Forestry, concurred in by the Secretary of Agriculture and Commerce, the land embraced in said mining claim included in Communal Forest Parcel I of Cataiñgan,, Masbate, appears to be mineralized; and

Whereas, under the provisions of section fourteen of Commonwealth Act Numbered One hundred and thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining, which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which reservation was made, may be withdrawn from such reservation by the President of the Philippines only with the concurrence of the National Assembly;

Now, therefore, I, MANUEL L. QUEZON, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Forestry Administrative Order Unnumbered, dated May twenty, nineteen hundred and twenty-two, the following parcel of land situated in the sitio of Buyag, barrio of Malobago, municipality of Cataiñgan, Province of Masbate, Island of Masbate, and described on Plan No. Mso.-8, to wit:

Beginning at point marked “1” on plan Mso-8, concrete monument, 15 by 15 by 60 cm., marked 1/C1-45, S. 79° 18' W., 2,662.88 meters, more or less, from B. L. B. M. No. 1, barrio of Malobago, Cataingan, Masbate, identical to corner 4 of Communal Forest Parcel I of Cataingan, Masbate; thence S. 40° 31' W., 202.22 meters to corner 2, a cuya-cuya tree, 1 meter diam.; thence S. 40° 02' W., 284.84 meters to corner 3, a magtalisay tree, 65 cm. diam.; thence S. 17° 37' W., 248.10 meters to corner 4, a magtalisay tree, 55 cm. diam., identical to corner 7 of Communal Forest Parcel I of Cataingan, Masbate; thence N. 61° 55' W., 347.27 meters to corner 5, a malaginis tree, 30 cm. diam.; thence N. 57° 37' W., 219.74 meters to corner 6, concrete monument 15 by 60 cm., marked 5/C1-45; thence N. 30° E., 724.16 meters to corner 7, concrete monument, 15 by 60 cm., marked 6/C1-45; and thence S. 60° E., 600 meters to point 1, the point of beginning.

Containing an area of 40.1054 hectares, more or less. The rights and privileges granted to and enjoyed by the residents of the municipality of Cataiñgan, Province of Masbate, under the order establishing Communal Forest Parcel I of Cataiñgan are henceforth continued and respected; and any time the said parcel of land shall be abandoned for mining purposes, the same shall revert to as part of Communal Forest Parcel I of Cataiñgan, Masbate.

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly adopted for the purpose.1aшphi1
