Proclamation No. 385

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 217, DATED FEBRUARY 16, 1929, A PARCEL OF LAND LOCATED IN THE MUNICIPAL DISTRICTS OF TUBA AND ITOGON, MOUNTAIN PROVINCE, ISLAND OF LUZON.

Whereas a petition has been filed for the release of certain mining claims located in the municipal districts of Tuba and Itogon, Mountain Province, from the Central Cordillera Forest Reserve established under Proclamation Numbered Two hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine;

Whereas, according to the report of the Director of Mines, dated December thirteenth, nineteen hundred and thirty-eight, concurred in by the Secretary of Agriculture and Commerce, the land embraced in the said mining claims now included within the Central Cordillera Forest Reserve appears to be mineralized; and

Whereas, under the provisions of section fourteen of Commonwealth Act Numbered One hundred thirty-seven, otherwise known as the Mining Act, lands within reservations for purposes other than mining which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President of the Philippines only with the concurrence of the National Assembly;

Now, therefore, I, Manuel L. Quezon, President of the Philippines, by virtue of the powers vested in me by law, do hereby exclude from the operation of Proclamation Numbered Two hundred seventeen, dated February sixteenth, nineteen hundred and twenty-nine, and open to disposition, under the provisions of Commonwealth Act Numbered One hundred and thirty-seven, the following parcel of land situated in the municipal districts of Tuba and Itogon, sub-province of Benguet, Mountain Province, Island of Luzon, and described on plan No. Bsm-38-D, to wit:

Beginning at a point marked "1" on plan of Bsm-38-D, being S. 52° OS’ E., 9,044.20 meters, more or less, from triangulation station, Santo Tomas, Baguio; thence S. 77° 13′ E., 300 meters to point 2; thence S. 12° 47′ W., 300 meters to point 3; thence S. 77° 13′ E., 814 meters to point 4; thence S. 9° 11′ W., 300 meters to point 5; thence N. 77° 13′ W., 170 meters to point 6; thence S, 9° 11′ W., 224.52 meters to point 7; thence S. 0° 17′ W., 390.18 meters to point 8; thence due East, 680 meters to point 9-; thence due South, 600 meters to point 10; thence due West, 1,600 meters to point 11; thence due South, 1,200 meters to point 12; thence due East, 1,398.69 meters to point 13; thence S. 25° 00′ W., 207.25 meters to point 14; thence N. 65° 00′ W., 300 meters to point 15; thence S. 25° 00′ W., 600 meters to point 16; thence N. 65° 00′ W., 721.85 meters to point 17; thence due West, 1,231.42 meters to point 18; thence due South, 300 meters to point 19; thence due West, 900 meters to point 20; thence due North, 900 meters to point 21; thence due East, 300 meters to point 22; thence due North, 300 meters to point 23; thence due East, 300 meters to point 24; thence N. 45° 00′ E., 1,272.76 meters to point 25; thence due North, 300 meters to point 26; thence due East, 10 meters to point 27; thence due North, 618.14 meters to point 28; thence N. 46° 40′ E., 378.42 meters to point 29; thence N. 9° 11′ E., 300 meters to point 30; thence S. 77° 13′ E., 258.38 meters to point 31; and thence N. 12° 47′ E., 300 meters to point 1, the point of beginning.

Containing an area of 596.8853 hectares.

Bounded on the north by the Sta. Fe Mining Company; on the east, by the Padkal Mining Company, International Mining Group, and the Tuban Mining Ass.; on the south, by the Engineers Group; on the west, by the Smith Group and the Cayapes Mining Group.

Bearings true. Declination, 0° 25′ E.

The cutting, removal, and disposal of the timber and other forest products shall be under the supervision and control of the Bureau of Forestry and that any time the said parcel of land’ shall be abandoned for mining purposes, the same shall revert to as part of the. Central Cordillera Forest Reserve.

This proclamation shall not take effect until it is concurred in by a resolution of the National Assembly duly adopted for the purpose.

In witness whereof, I have hereunto set my hand and caused the seal of the Commonwealth of the Philippines to be affixed.
