RESOLUTION No. 8865

EXTENSION OF THE PERIOD FOR FINAL TESTING AND SEALING OF THE
PRECINCT COUNT OPTICAL SCAN (PCOS) MACHINES.

WHEREAS, in Resolution No. 8785, promulgated on February 24, 2010, the Commission on Elections fixed the period for testing and sealing of the Precinct Count Optical Scan (PCOS) machines at least three(3) days before the May 10, 2010 National and Local Elections;

WHEREAS, the purpose of the final testing and sealing of the PCOS is to determine whether or not the Automated Election System (AES) is working properly, securely and accurately. Since the conduct of May 3, 2010 final testing and sealing in some areas revealed glitches in the configuration for local positions, there is a need to suspend the conduct of final testing and sealing in all areas until such time as the configuration for local positions have been corrected;

WHEREAS, Section 12 of Republic Act No. 9369 requires the examination and testing of the equipment or device of the AES to be used in the voting and counting and the same is allowed even on the day of the electoral exercise before voting starts;

NOW THEREFORE, the Commission of Elections, by virtue of the power vested by the Constitution, the Omnibus Election Code, other election laws and jurisprudence, has RESOLVED, as it hereby RESOLVES to extend the period of final testing and sealing up to May 9, 2010.

RESOLVED moreover, to direct the Election Officers to notify the Boards of Election Inspector (BEIs) concerned of the new date, time and place of the testing and sealing. In case of candidates, registered political parties, associations or organizations participating in the party-list system of representation, accredited citizens arm in the city or municipality, the EO shall notify them by posting a notice of the new date, time and place of testing and sealing for each clustered precinct in the bulletin boards of the Offices of the Election Officers (OEOs) and of the city or municipal halls and in at least three (3) conspicuous places in city or municipality.

The education and Information Department (EID) shall cause the immediate publication of this Resolution and shall furnish copies thereof to all Regional Election Directors, Provincial Election Supervisors, Election Officers and Boards of Election Inspectors nationwide.
