IN THE MATTER OF THE MEMORANDUM OF THE LAW DEPARTMENT RELATIVE TO THE CERTIFICATES OF CANDIDACY FOR THE POSITIONS OF PRESIDENT, VICE-PRESIDENT AND SENATOR IN CONNECTION WITH THE MAY 10, 2004 ELECTIONS

Promulgated: 17 January 2004

This pertains to the Memorandum of the Law Department dated 11 January 2004, relative to the Certificates of Candidacy for the positions of President, Vice-President and Senator which were filed before the Law Department.

The Memorandum reads:

COMMENT AND RECOMMENDATION:

Out of the eighty four (84) candidates for the Office of President, only five (5) candidates have been nominated by a political party, namely:

1. Gil, Eddie C. - Partido Isang Bansa Isang Diwa

2. Lacson, Panfilo M. - LDP - Aquino Wing

3. Macapagal-Arroyo, Gloria M. - LAKAS-CMD

4. Poe, Fernando Jr./Ronald Allan K. - Koalisyon ng Nagkakaisang Pilipino (KNP)

5. Roco, Raul S. - Aksyon Demokratiko

All the other seventy nine (79) candidates were not nominated by any political party and are, therefore, independent candidates.

Candidate Josefino A. Buitizon filed on January 3, 2004, an affidavit of withdrawal of his certificate of candidacy, which was in due form and substance.

A cursory reading of the certificates of candidacy of Alfonso Celmar, Fernando Delizo, Wendell Lope and Peter Paul Macaya showed that they lack the age requirement of at least being forty (40) years of age on the day of the election. (Sec. 2, Art. VII, Phil. Constitution). The date of birth of Alfonso Celmar is August 2, 1967. Fernando Delizo was born March 3, 1967, Wendell Lope on March 6, 1975 and Peter Paul Macaya on February 3, 1970. On the day of the election, these candidacies are still below forty years of age.|avvphi1.nêt

Idjirani B. Limpasan also filed his certificate of candidacy for senator on December 31, 2003, a day after he filed his certificate of candidacy for president without a withdrawal of the latter. Under Section 73, Omnibus Election Code, he is ineligible for both positions.

For the Office of Vice-President, only three (3) candidates were nominated by a political party, namely:

1. Aquino, Herminio S. - Aksyon Demokratiko

2. Legarda, Loren B. - Koalisyon ng Nagkakaisang Pilipino (KNP)

3. PAJO, Rodolfo T. - Partido Isang Bansa Isang Diwa

Noli de Castro, an incumbent Senator was not nominated by any political party. Although an independent candidate, he is the running mate of President Gloria Macapagal-Arroyo.

On January 5, 2004, Salvador L. Jocson filed an affidavit of withdrawal of his certificate of candidacy, which was in due form and substance.

For Senator, the following candidates were nominated by duly registered political parties, to wit:

Among the independent senatorial candidates, Heherson Alvarez is considered a public figure having been a former senator, a department secretary and spokesman of LAKAS.

Incumbent Senator John Osmeña who is seeking re-election is not nominated by any political party but he is among the senatorial line-up of President Gloria Macapagal-Arroyo.

Mr. Roberto Brillante of Partido Isang Bansa Isang Diwa withdrew his certificate of candidacy on January 08, 2004, alleging that his certificate of candidacy was filed by his party without his expressed consent and approval.

A review of the records of the Law Department will show that many of the independent candidates previously filed their certificates of candidacy for the position of either president, vice-president or senator during the past elections, but were denied due course by the Commission. To mention a few:

There is a need to limit the number of candidates especially in the case of candidates for national positions because the election process becomes a mockery even if those who cannot clearly wage a national campaign are allowed to run. Their names would have to be printed in the Certified List of Candidates, Voters Information Sheet and the official Ballots. These would entail additional costs to the government. For the official ballots in automated counting and canvassing of votes, an additional page would amount to more or less FOUR HUNDRED FIFTY MILLION PESOS (P 450,000,000.00).

While the constitution provides that the state shall guarantee equal access to opportunities for public service, it serves no practical purpose to allow those candidates to continue if they cannot wage a decent campaign enough to project the prospect of winning, no matter how slim.

In the case of Francisco “Frank” M. Tajanan and Leopoldo “Pol” B. Quesada vs. Commission on Elections, G.R. No. 10443, dated April 13, 1992, the Supreme Court ruled:

“xxx This does not mean that this Court is declaring national politics as the sole preserve of the so-called ‘traditional politicians’. However, given the complexity of the present political exercise, which involves the election of government officials from the President down to city and municipal officials. We recognize the need to keep the number of candidates to a manageable level, and this means keeping those who are not serious in running for office out of the race.”

Considering the dignity that must be accorded the Offices of the President, Vice-President and Senators, the magnitude of the responsibility of those officers, the following criteria was observed in the determination of the candidates who have bona fide intention to run for the office for which they seek to be elected:

1. Candidates who, on the face of their certificate of candidacy, do not possess the constitutional and legal qualifications of the office to which they aspire to be elected;

2. Candidates who, on the face of said certificate, filed their certificate of candidacy to put the election process in mockery or disrepute;

3. Candidates whose certificate of candidacy would cause confusion among the voters by the similarity of names and surnames with other candidates; and

4. Candidates who have no intention to run for the office for which the certificate of candidacy has been filed as shown by circumstances or acts that clearly demonstrate the lack of such bona fide intention, such as:

a) candidate who cannot wage a nationwide campaign;

b) candidates who do not have a platform of government;

c) candidates who are not nominated by a political party or are not supported by a registered political party with national constituency; and

d) candidates for president or vice-president who do not present running mates for president or vice-president, respectively, nor senatorial candidates.

PREMISES CONSIDERED, the Law Department RECOMMENDS as follows:

Sec. 69 of the Omnibus Election Code as amended by Section 5 of R.A. No. 6646, gave COMELEC the power to motu proprio cancel or deny due course to a certificate of candidacy of registered candidates. It provides:

“Sec. 69. Nuisance candidates – The Commission may, motu proprio or upon verified petition of an interested party, refuse to give due course to or cancel a certificate of candidacy if it is shown that said certificate has been filed to put the election process in mockery or disrepute or to cause confusion among the voters by the similarlty of the names of the registered candidates or by other circumstances or acts which clearly demonstrate that the candidate has no bona fide intention to run for the office for which the certificate of candidacy has been filed and thus prevent a faithful determination of the true will of the electorate.”

Sec. 6 of Resolution No. 6452 “Rules delegating to Comelec field officials the hearing and reception of evidence of disqualification cases filed in connection with the May 10, 2004 National and Local elections; motu proprio actions and disposition of disqualification cases”, reads:

“Sec. 6. Motu Proprio Cases. – The Commission may, at any time before the election, motu proprio refuse to give due course to or cancel a certificate of candidacy of any candidate for the positions of President, Vice-President, Senator and Party-list:

1. The grounds:

a) Candidates who, on the face of their certificate of candidacy, do not possess the constitutional and legal qualifications of the office to which they aspire to be elected;

b) Candidate who, on the face of said certificate, filed their certificate of candidacy to put the election process in mockery or disrepute;

c) Candidates whose certificate of candidacy could cause confusion among the voters by the similarity of names and surnames with other candidates; and

d) Candidates who have no bona fide intention to run for the office for which the certificate of candidacy had been filed or acts that clearly demonstrate the lack of such bona fide intention, such as:

1. Candidates who do not belong to or are not nominated by any registered political party of national constituency;

2. Presidential, Vice-Presidential who do not present running mates for vice-president, respectively, nor senatorial candidates;

3. Candidates who do not have a platform of government and are not capable of waging a nationwide campaign.

2. Procedure:

a) Upon receipt of the certificates of candidacy for the offices of President, Vice-President and Senator, the Law Department shall within five (5) days from the last day for filing certificate of candidacy, forward to the Commission en banc through the Office of the Comelec Secretary, the certificates of candidacy together with its study and recommendation;

b) The Comelec Secretary upon receipt thereof shall immediately calendar for deliberation the certificates of candidacy together with the study and recommendation of the Law Department with notice to all members of the Commission;

c) Within five (5) days from the date of the deliberation, the Commission shall resolve all matters relative to the certificates submitted to it;

d) The resolution shall be published in two (2) newspapers of general circulation;

e) Any candidate whose certificate of candidacy has been adversely affected may personally or through authorized representative file a verified opposition thereto in ten (10) legible copies, within five (5) days from date of publication with the Office of the Clerk of the Commission who shall assign a docket number which must be consecutive according to the order of receipt and must bear the year and prefixed as SPA (MP);

f) The Clerk of the Commission shall set the opposition for hearing within three (3) days from receipt thereof.

3. Decision:

Within two (2) days after the hearing, the Clerk of the Commission shall calendar the Opposition for consultation and thereafter, the member to whom the case is assigned shall pen the decision within five (5) days from the date of consultation.”

During the deliberation of the sufficiency of the certificates of candidacy, and the above memorandum of the Law Department, the Commission, considering the dignity that must be accorded the office of President, Vice-President and Senator, the minimum qualifications established by the Constitution and electoral laws, the magnitude of the responsibilities of this office, as well as the need to wage a nationwide election campaign, observed that there are indications that the various certificates were filed to put the election process in mockery or disrepute or to cause confusion among the voters by the similarity of names of the registered candidates or by other circumstances or acts which clearly demonstrate that the candidate had no bona fide intention to run for the office for which the certificate of candidacy has been filed and thus prevent a faithful determination of the true will of the electorate.

In view of the foregoing, the Commission RESOLVED, as it hereby RESOLVES, to APPROVE the recommendation of the Law Department, with modification as follows:

A. 1. To GIVE due course to the certificates of candidacy of the official candidates for president of the following political parties, namely:

a) ROCO, RAUL S. - Aksyon Demokratiko

b) POE, FERNANDO/RONALD ALLAN K.- Koalisyon ng Nagkakaisang Pilipino (KNP)
