RESOLUTION No. 6368

IN THE MATTER OF THE OFFICIAL BALLOT DESIGN IN CONNECTION WITH THE FORTHCOMING 2004 NATIONAL AND LOCAL ELECTIONS

Promulgated: 13 October 2003

WHEREAS, Republic Act No. 8436 known as the Election Modernization Law mandates that the Commisison on elections prescribe the size and form of the official ballot to be used during the conduct of the May 10, 2004 National and Local Elections.

WHEREAS, the following ballot designs were presented by the Executive Committee during the regular En Banc meeting of the Commission held on 30 September 2003:lªvvph¡1.ñét

Hybrid or partial codingOn the face of the ballot:
The names of candidates for President, Vice-President and Senators are printed while the Party-List are coded

At the back of the ballot:
The names of the candidates for Congressman, Governor, Vice-Governor, Mayor and Vice-Mayor are printed while the names of the Board Members and councilors are coded.

WHEREAS, the different features of each ballot design were thoroughly discussed, taking into account the provision of the pertinent law on the kind of the ballot to adopt;

WHEREAS, based on historical data from past elections where there were various elective positions, the necessity of an official ballot design that is flexible enough to accomodate a large number of candidates for elective positions and in a format that is user-friendly is imperative;

WHEREAS, the Hybrid or Partial Coding Design presented by the Executive commitee addresses the needs of the Commission and was identified as the most flexible Official Ballot design from among the options available;

WHEREAS, the Hybrid or Partial Coding Design of the Official Ballot may be sbject to modification as a result of theintegration of all Phases of the Modernization Program and incoordination with the suppliers of the Autoamted Counting Machines (ACMs) and application software, the organic personnel involved in the preparation of the Automated Systems and Manual Procedures and other persons or organizations involved in the Modernization Program of the Commission;

WHEREAS, on 06 October 2003 the Executive Commitee presented to the commission En Banc for its approval a modified version of the Official Ballot with Hybrid Design or Lotto type selection of candidates for Party-List and Councilors which portions are deluged with candidates, a copy of which is hereto attached as Annex "A".

NOW THEREFORE, the Commission RESOLVED, as it hereby RESOLVES:

1. To approve the attached modified Hybrid Design, as the Official Ballot Design for the 2004 elections, subject to the condition that each position be printed in bold letters and enough space be provided to distinguish one position from the other;

2. Launching of said Official Ballot design shall be on or before 21 November 2003.

Let Phase II of the Moderniztion Project implement this resolution.
